New Year Carnival - Terms & Conditions
“WeChat” is a mobile communication and social networking application developed and owned by WeChat International Pte. Ltd.,a company incorporated in Singapore. All the ownership rights, title and interest of intellectual property rights relating to the software(including but not limited to any code, image, data, text and add-in programs contained in the software and in any and all future updates, modifications, revisions and/or derivative works of the software),trademarks, service marks and logos etc. pertaining to WeChat along with attached supporting documentation belong solely toWeChat International Pte.Ltd and not 10CIndia Internet Pvt. Ltd (10C India).10C India is an independent contractor of an affiliate of WeChat International Pte.Ltd. It has neither the right nor the ability to represent or bind any other person in the Tencent group.
By participating in the New Year Carnival (“the Contest”) hosted by 10C India, contestants hereby accept and agree to the following terms (collectively, the “Agreement”):
1. Contest Period The Contest begins on 27 Dec 2013 and ends on 2 Jan 2014 (both days inclusive).
2. Eligibility The Contest is open to Indian citizens who are residents of India and above the age of eighteen (18) years and who hold a valid PAN card issued by the Income Tax Department. 10C India employees and their immediate family members are not eligible to participate in the Contest.
In the event that a contestant who is not eligible to compete wins any prize mentioned in Clause 7 below (“Prize”) in this Contest, they shall be disqualified and shall not be entitled to the Prize.
4. Contestant Details Contestants agree to provide complete and correct information and proof with respect to their identity, residence, contact details, age, and such other information as may be required by 10C India. Contestants agree that personal data submitted with an entry or pursuant to any requisition by 10C India, its affiliates and their respective agents, including name, mailing address, phone number, and email address may be collected, processed, stored and otherwise used by 10C India and its affiliates for the purposes of conducting and administering the Contest. By entering the Contest, contestants agree to the transmission, processing, disclosing and storage of this data by 10C India, its affiliates and their respective agents.
5.Selection of Winners
(a) Daily Winners Three (3) daily winners will be selected based on the top 3 contestants who have completed the daily task required by 10C India.
(b) Grand Prize Winners Five (5) overall winners will be selected for Grand Prizes at the end of the Contestbased on the following criteria:
Participation in all required daily tasks; and will be selected based on the top 5 contestants who have completed the daily task required by 10C India and securing maximum score (score = number of broadcast * number of friends sent to)
10C India reserves the right to change the tasks required, prizes to be provided and winner selection methods at its sole discretion without any prior notification and without assigning any reason.
10C India or other persons retained by 10C India in connection with the Contest may need to contact the contestant by email, telephone, WeChat or other means. By entering the Contest, all participants permit 10C India to, and to authorize other persons to, to contact him or her through any means.
6. Announcment of Winners Winners will be announced by Jan 10, 2014
7. Prizes The 3 daily winner will win Google Nexus 4 (1st) and Samsung S3 (2nd & 3rd).The 1st Grand Prize winner will win an iPhone 5s, the 2nd Grand Prize winner will win a Samsung S4, the 3rd, 4th and 5th Grand Prize winner will win iPad Mini.
The Prizes are non-transferable and are not redeemable for cash. The Prizes are subject to the laws of India. Any deduction of taxes, levies and any other statutory payments shall be as applicable and be borne solely by the winner and paid for by the winner.
10C India shall not be liable for any loss, damage, theft, or any other mishap caused to the Prize(s) after handing over the same to the winners.
8. Collection of Prize The winners need to provide their name, address, contact number, email address and identity proof to indiawechat@gmail.com to claim their prize. Winners need to provide the aforementioned details within four (4)business days from the date of the announcement of winners.
Prizes must be collected by the winners within two (2) months of the announcement of winners. Any prize not claimed after two (2) months of the announcementof winners will be forfeited and the winner whose prize has been forfeited shall not be entitled to any payment or compensation 10C India.
9. Received Entries By submitting their entries, contestants attest that their entries are original and have not been previously published or submitted as entries in any other competition, which are created solely by the contestants, and that use of the entry (and all elements depicted therein) shall not violate the right of any third parties and shall not violate any applicablecentral, state or local laws or ordinances. Contestants shall indemnify, and shall hold 10C India and its affiliates harmless, against any losses, claims or costs that arise directly or indirectly from a breach by their infringement of any person’s rights or property.
All rights, titles and interests(including but not limited to intellectual property rights) in the promotional material(s) and any and all entries received shall vest solely and exclusively with 10C India at all times. To the extent that applicable law does not permit such vesting, and as a condition of entry, the contestant grants 10C India a perpetual, irrevocable, worldwide, transferable, royalty-free, and exclusive license to use, reproduce, adapt, modify, publish, distribute, publicly display, create a derivative work from, and publicly display the entries and any information in connection therewith for any purpose, including but not limited to television, internet, mobile, print, without any attribution or compensation to the contestant. Entries will not be returned.
10. Exclusion of Liability 10C India shall not be liable for any loss or damage whatsoever that maybe suffered, or for any personal injury that maybe suffered, as a result of participating in this Contest.For any breach (whether fundamental or otherwise) of any part of this Agreement, 10C India shall be liable to pay an aggregate sum of not more than INR 10,000.
10C India shall not be responsible for the quality, deficiency of any product or service (including the Prizes), in any manner whatsoever.
11. Taxes All taxes on any prizesshall be the sole and exclusive liability of the winners. Prizesare subject to the express requirement that the contestant submit to 10C India all documentation requested by it to permit it to comply with all applicable tax reporting. All prizes will be net of any taxes that are required by law to withhold and towards any amount that 10C India determines to be the amount of taxes payable in connection with any prizes shall be payable by the winner to 10C India. In order to receive a prize, potential winners must submit tax documentation requested by 10C India or otherwise required by applicable law.
12. Additional Terms 10C India reserves the right to change, alter or cancel any or all of the applicable terms and conditions at any time at its sole discretion, without any prior notice and without assigning any reason. The decision of 10C India shall be final on all matters relating to this Contest (including but not limited to the resolution of any tie, selection of winners, eligibility of contestants etc.) and no correspondences will be entertained.
Any dispute in relation to the Contest, the entries, the prizes or this Agreement shall be governed by Indian law. All such disputes shall be subject to the exclusive jurisdiction of the courts at Gurgaon.
